Claim rejected for Down Syndrome son

A recent [b]Western Cape High Court (Cape Town)[/b] judgment has crushed a Cape Town woman’s hopes of claiming millions in damages from a [b]Claremont[/b] foetal assessment clinic on behalf of her Down Syndrome son, says a [s]Weekend Argus[/s] report. However, it isexpected that the woman will take steps to appeal in an attempt to have wrongful life actions recognised in SA law. The mother is claiming R6.5m in damages on the child’s behalf. The clinic argued that the type of claim – a wrongful life action – was not recognised in SA law.
