Discovery judgments mount amid RAF dispute

Discovery Health says it has obtained judgments totalling more than R170m since the RAF’s controversial directive not to reimburse past medical expenses where a beneficiary had medical scheme coverage.

According to a Die Burger report on the Legalbrief site, Discovery Health CEO Ron Whelan said the RAF had not resumed payments even after judgments setting aside the RAF’s directive.

Discovery is awaiting a hearing date for a full court to consider its contempt of court application against the RAF and its CEO, Collins Letsoalo.

The matter was argued in March before a single judge, but was then postponed to serve before three judges.

The parties will meet the Judge President next week to obtain a date.

Discovery Health called the directive “blatant discrimination” against those road users who pay the same RAF fuel levy as everyone else.

The R170m owed to members of the schemes, including Discovery, has a direct effect on all scheme members, as it got paid from the general risk pool.
