The return date for comment on Discussion Paper 154 on Project 141: Medico-legal Claims, has been extended, says the SA Law Reform Commission.
As reported in MedicalBrief on 17 November 2021, SALRC has proposed sweeping legal changes to curb the soaring medical negligence claims against the State. A “uniquely South African system” is envisaged, expanding on common law changes already initiated by the Constitutional Court.
The Commission had asked for public input on the changes, outlined in a medico-legal claims discussion paper that notes “the escalation in medical negligence litigation against the state, and, in particular, the increase in … size of the damages sought and awarded”. The paper includes proposals for primary and secondary prevention strategies to reduce medico-legal litigation
The initial return date for comment was 31 January. However, SALRC has received a number of requests for an extension of the return date for comment, and has therefore extended the return date for comment to 28 February 2022.
